ABSTRACT

"The lecture deals with two main topics; the first one relates to the question of granting temporary or preliminary injunction. This topic is dealt with a reference to a recent final decision of the Supreme Court which contains several very interesting and meaningful statements concerning the legal preconditions of granting a preliminary injunction, such as rendering probable the alleged infringement, comparison of the advantages and disadvantages caused to plaintiff and defendant, respectively, and the payment of a security. The second topic is a legally not binding decision of the Metropolitan Court, confirming the infringement of a use claim, drafted in a process format, said claim protecting an invention based on the recognition of the second veterinary use of a compound by a specific way of administration."
